Objective: The session intended to present the history and evolution of the GPA 2012 as a market opening and good governance tool containing international best practices. The session also explored key elements of the GPA 2012, its underpinning economic rationale and policy considerations for developing economies.

Evidence: The presentations under session 1 were pertinent and contributed to the overall success of the event. In correspondence with the heading and as a starting point, the main features, objectives and key principles of the GPA 2012 were presented in a comprehensible manner. Economic rationale for the liberalization of government procurement markets has been discussed setting up the scene for future discussions throughout the event. In addition, history of the GPA and its role in development and good governance were part of session 1.

Conclusion: Session 1 fully met its objectives as is evident from PEF results. It set up a good basis on which the rest of the event was built. Participants were also actively involved in the live opening session held on 25 October 2022.

Objective: The session focussed on the main substantive and procedural requirements embodied in the text of the GPA 2012. It also explored the flexibilities embodied in the GPA 2012 to face situations of extreme urgency (e.g. COVID-19).

Evidence: The aim of session 2 was to discuss the main elements of and flexibilities provided by the GPA 2012. Special attention was paid to the government procurement practices under the circumstances mandated by COVID-19. The case of the UK has been discussed in this regard.

Objective: Different aspects related to the implementation of the GPA 2012 were discussed during this session, such as e-procurement, sustainable procurement, SME participation in government procurement. Attention was also given to international instrument (e.g. the UNCITRAL Model Law and the United Nations Convention Against Corruption (UNCAC)) that are relevant to the domestic implementation of the GPA 2012.

Evidence: During this session, the implementation of the GPA 2012 was at the centre of discussion. Case studies of Moldova and Canada were explored showed the links of the GPA with wider policy issues such as the e-procurement and green procurement policies. The explicit synergies of the GPA 2012 and the UNCAC were presented by the WTO Secretariat and the UNODC experts complementing the understanding of how the GPA 2012 can be used as a tool to fight corruption in the government procurement area. Last but not least, measures for the detection and prevention of anti-competitive practices in government procurement have been explored.

Objective: The GPA 2012 is first and foremost a trade agreement. This session addressed the market access opportunities available under the GPA 2012, and introduced the e-GPA Gateway to facilitate access to the GPA market access information. In addition, the role of data in policy-making in the government procurement field was discussed.

With regard to the usefulness of the breakout session No 1, analysis of the evaluation forms shows that 96% of the respondents considered it to have been satisfactory (score 3 or higher) and 70% considered the usefulness to be high or excellent (score 4 or 5).

Evidence: This session was organized to inform the participants about the market access opportunities granted by the GPA to its Parties. The WTO e-GPA gateway, using which it is possible to gain access to the information about the GPA coverage of the Parties, was presented. Participants were also tasked with an assignment to be completed using the information provided in the e-GPA while working in small groups during a live breakout session.

Objective: The GPA 2012 is one of the few international trade agreements envisaging both domestic and international enforcement of its rules. During the session, enforcement at both levels was discussed, including the experience of the US and the cases brought under the DSU.

Evidence: The module started with the description of the requirements related to the domestic enforcement of the GPA 2012 rules followed by practical examples of implementation in the US and Switzerland. The module was concluded by a presentation explaining the GPA 2012 enforcement under the DSU rules. Another breakout session was organized where the participants were asked to compare their national legislation with the requirements of the GPA 2012 and present their main findings in a virtual plenary room.

Objective: The Committee on Government Procurement (CGP) administers the GPA 2012. The participants were introduced to it by the most recent former Chair of the CGP and CGP delegates. An opportunity was provided to reflect upon the potential benefits, challenges and modalities of accession to, and participation in, the GPA 2012, and the flexibilities available to developing countries seeking accession to the Agreement.

Evidence: Session 6 aimed at describing the process and procedure of acceding to the GPA 2012. It was detailed and comprehensive considering that the vast majority of the participants were coming from WTO Members that are still not Parties to the GPA. Special and differential treatment for developing and least developed countries wishing to accede to the Agreement has been the focus of a separate presentation. In addition, the session touched upon the strategy of accession, economic rationale and ways of building domestic support from different stakeholders.

Objective: The GPA 2012 does not operate in a vacuum and this session aimed to explore the synergies and complementarities with other international instruments, as well as the relevance of the GPA for wider trade policy objectives (e.g. public health).

With regard to the usefulness of the roundtable discussion on GPA accession negotiation strategies, analysis of the evaluation forms shows that 90% of the respondents considered it to have been satisfactory (score 3 or higher) and 61% considered the usefulness to be high or excellent (score 4 or 5).

Evidence: Session 7 looked at the GPA 2012 in a broader policy context and showws how it relates to e.g. trade in general, competition, IP and public health. The GPA 2012 has also been described as a "template" for many government procurement chapters in RTAs and has clear links with the recent WB procurement guidelines, all of which was explored within the scope of this session. A live roundtable discussion involving national experts has also been organized to discuss different negotiation strategies when acceding to the GPA.

Objective: The activity concluded with the overall assessment of the effectiveness of the GPA 2012 and a reflection on the past, present and future of the Agreement.

Evidence: Session 8 was the concluding session of the event that took a holistic approach when looking at the GPA from a historical point of view while also restating what has been discussed in session 1: the importance of the GPA for economic development, good governance and efficient procurement procedures. The session also included a closing live event with a dedicated section for a Q&A where the participants raised inter alia content-related questions.
